Oklahoma man to be executed for 1986 murder

TULSA, Okla. (AP) - An Oklahoma man convicted of fatally shooting his fiancee in 1986 is scheduled to be executed Tuesday evening despite his pleas that he is mentally incompetent and ineligible for the death penalty.

Garry Thomas Allen is set to die by lethal injection at the Oklahoma State Penitentiary in McAlester.

He was convicted of shooting Lawanna Gail Titsworth outside a children's day care in Oklahoma City. Titsworth had moved out of the home she shared with Allen and their two sons four days before her death.

Allen's attorneys had argued that Allen was incompetent when he entered a guilty plea in the case and that his mental condition has continued to deteriorate, but appellate courts have rejected those claims.

Allen's attorney has requested a stay from the U.S. Supreme Court.
